Stem cell therapies can be legally administered in the United States when they meet specific criteria outlined by the U.S. Food and Drug Administration (FDA) under Section 361 of the Public Health Service (PHS) Act. This regulatory pathway permits the clinical use of certain human cells and tissues, including stem cells, without requiring individual FDA approval—provided the treatment adheres to clearly defined guidelines established for Human Cell and Tissue-Based Products (HCT/Ps).

To qualify as a “361 product” and remain within the legal framework, stem cell therapies must meet four key conditions:

  1. Minimal Manipulation: The stem cells must undergo only limited processing, remaining in their original form as harvested from the donor. Extensive culturing, genetic modification, or any alterations beyond what is necessary for safe and effective use are not permitted.

  3. Homologous Use: The cells must be used in a way that mirrors their natural function in the donor’s body. For instance, bone marrow-derived stem cells should be used to treat conditions affecting the blood or immune system—not unrelated conditions like neurological disorders.

  5. No Combination with Other Products: Stem cells must not be combined with drugs, biologics, or medical devices. If such combinations occur, the therapy may fall under stricter FDA regulations that require full pre-market approval.

  7. Demonstrated Safety and Low Risk of Contamination: Stem cell products must meet stringent safety standards, including thorough donor screening for infectious diseases and adherence to clinical safety protocols that reduce patient risk.

When all of these conditions are satisfied, stem cell treatments may be offered legally under Section 361 without the need for full drug or biologic approval. However, not all clinics comply with these requirements. Some therapies promoted in the marketplace may involve unapproved uses or processing methods that fall outside legal boundaries.
